A previously convicted drunk driver will not serve a day behind bars for an alcohol-fueled crash which killed his fiancé on Valentine's Day and left three other innocent motorists seriously injured.
Edward Sinclair, 51, was handed a two-year-less-a-day conditional sentence Thursday which allows him to remain free in the community.
Provincial court Judge Linda Giesbrecht cited Sinclair's claims of being a "role model" in the native community as a key factor in her decision to reject the Crown's bid for a two year jail term.
Giesbrecht said she was also following a Supreme Court edict which tells judges to give special consideration to some Aboriginal offenders based on their troubled upbringing.
Sinclair had told a probation officer he began drinking at a young age after seeing his father do it and has fought a losing battle with the bottle ever since because of his culture.
"His perception of inequality in his younger years has contributed to his use and abuse of alcohol," said Giesbrecht.
